GUIDELINES

All submissions for Human Rights Law Journal must adhere to the following guidelines; Theme for Submission

Over the last fifty years the international law of human rights has steadily achieved a moral plateau rarely associated with the law of nations. A diverse and eclectic assortment of  individuals and entities now invoke human rights norms and the attendant phraseology with the intent of cloaking themselves and their causes in the paradigm’s perceived power and righteousness. What  is interesting is the failure of this universal reliance on the language of human rights to create agreement on the scope, content, and philosophical bases of the human rights corpus. Intellectual and policy battles have focused on its cultural relevance and ideological aberrations. The human  rights corpus, taken as a whole, as a document of ideals and values, particularly the positive law of human rights, requires the construction of states to reflect the structures and values of governance  that derive from liberalist ideals, especially the contemporary variations of liberal democracy practiced in Western democracies. Viewed from this perspective, the human rights regime has serious and dramatic implications for questions of cultural diversity, the sovereignty of states, and   the universality of human rights.

In the same vein, the Human Rights law Journal will focus on the following dominant discourses on the human rights;

  • Human Rights, Democracy and the Rule of Law
  • Gender Justice and Human Rights
  • Human Rights of Tribes and Indigenous People
  • Human Rights and Racial Discrimination
  • Expanding Horizons of Human Rights in the 21st Century.
  • Human Rights and the financial inclusion.

Note: Authors are free to choose any sub-topics under these themes and areas. Submissions should demonstrate strong methodological approach, high  writing quality, robust analysis, and adherence to the topic.

Eligibility: We welcome Submissions from students, academicians, researchers and legal practitioners, to come up with their contributions in the form of articles, case comments, legislative comments and book reviews. Our only requirement is quality and non plagiarised submissions.

Background
In the continuation of the Data Protection Series, the Editorial Board of RSRR has sought to dig deeper on the topic of Data Protection. The First Issue aimed at gauging a more general understanding and comparison of data protection laws, whereas, through this issue, we target more specific areas which the data protection framework touches/encompasses.
There are certain standard clauses/provisions that are found in every Data Protection Law and Private Privacy Policies across the globe. Through this issue, we aim to study these standard provisions, the loopholes in them, the potential benefits and how they should be properly drafted. Other than protecting the civil liberties of individuals, a data protection regime touches the corporate sector in a multifarious manner, for instance, the compliance cost of running an enterprise increase, and particularly small companies face an increased financial burden due to the standards they have to meet as per the Data Protection law.
Moreover, a certain “chilling effect” is possible for companies, which are at the risk of facing huge amounts of fine due to the data breach. Furthermore, data localization has been another conundrum which is being debated in the nascent Indian scenario. These topics are of utmost relevance in the current scenario, as the Legislature has a prepared draft of legislation on Data Protection, based on Justice B.N. Shrikrishna Report.
Therefore, we expect original and novel posts which can add to the discourse of Data Protection.
Sub- Themes
  1. Privacy by Design.
  2. Fines and penalties imposed under the Data Protection Laws.
  3. Categorization of Data as Sensitive Personal Data.
  4. Data Portability.
  5. Compliance costs on Companies.
  6. Possibilities of Erasure of Data: Right to be Forgotten.
  7. Standards in duties and responsibilities of Data Collectors.
  8. Disclosure Requests.

The submissions are, however, not restricted to the aforesaid sub-themes, provided they fall within the ambit of the main theme.
