Chicago is home to some of the most reputed law schools in the country, and over 20% of the city’s population are students. A good law degree can help guarantee financial stability and prestige. Before applying to law school, aspiring law students must attain specified GPAs and pass tests like the LSAT. Smt. Maneka Sanjay Gandhi, Member of Parliament during the question hour of Loksabha on 24.07/2019 asked the Hon’ble Minister of Law & Justice Shri, Ravishankar Prasad that:

(a) whether the Government proposes to nationalize the National Law Universities (NLUs) and providing them the same status as accorded to other National Institutes and if so, the details thereof;

(b) whether the Government is planning to undertake measures to provide adequate complaint mechanism in NLUs keeping in mind the constant strikes and protests therein and if so, the details thereof along with the
complaints/protests during the last two years; and

(c) whether the Government is proposing to provide uniform academic standards and centralized funding to reckon with the problems in the NLUs and if so, the details thereof?

 

To which the minister responded that:

“There is no proposal before the government to nationalize National Law Universities. The management of NLUs is done by them and the academic curriculum and standards is decided by them in consultation with the Bar Council of India.”

All NLUs without exception are state universities. Established by statutes enacted by various state legislatures, the adjective ‘national’ only describes the initial idea that facilitated their creation. For instance, the National Law School of India University was set up by a 1986 Karnataka Act and NALSAR University of Law by an Andhra Pradesh Act of 1998. As a result,  these law schools rely majorly on grants from state governments – as against other institutions of excellence, such as the Indian Institutes of Technology (IITs), which are funded by the Centre. Grants from different states being greatly non-uniform, the fees charged by most of the law schools is usually very high and can go up to about Rs 2 lakhs per annum, inclusive of tuition and other fees (such as hostel rent and mess charges). 

NLUs today are inefficiently administrated institutions that fail to provide basic facilities such as decent faculty, proper classrooms, proper residential areas, a functional library, hygienic environment and other such necessities due to which almost NLU’s student have to protest against their management for basic facilities which result in loss of academic sessions. In absence of uniform academic standards and centralized funding, the disparity within different NLUs themselves is a problem to be reckoned with. Centralization in administration through nationalization of these institutions is the only long-term solution to this problem.

Failure to do so might disrupt entirely the next generation of social-engineers that the National Law School Project was destined to create when it was set up three decades back by Prof. Madhav Menon.

A private member’s Bill i.e, THE NATIONAL LAW UNIVERSITIES OF INDIA BILL, 2016 to nationalise legal education was introduced in the Lok Sabha by Prof. (Dr.) Sugata Bose in March earlier this year for Declaration of the NLUs as ‘Institutes of National Importance’ which further makes the Parliament competent to legislate on the subject. Reservation of seats for state domicile students to be decided by state order to be maximum of 50% of the seats. Formation of a new National Council to harmonize working of the NLUs, advise on matters of the common admission test, resolve inter-NLU disputes, examine annual budget sessions and recommend to the Central Government allotment of funds. The Union Minister of Law is the Chairperson ex-officio. This does not infringe in any way on the power of the Bar Council of India to regulate legal education and it only to ensure proper functioning of the NLUs, not to decide on policy matters of legal education throughout the country or prescribe standards thereof.

But the revert that comes from Law Minister implies that government doesn’t want to interfere in the management of NLUs.

“Our books, quest and hunger for knowledge and our pens are the most powerful weapons”,  says Hon’ble Justice Kanwaljit Singh Ahluwalia, Chief Guest, on the occasion of inaugural function of 2nd edition of Model Youth United Nations organized by Seedling School of Law and Governance, Jaipur National University, on 13th April, 2019.  

Justice Ahluwalia urged the participants to develop the ideas and evoke quest for knowledge. Citing the example of Steve Job the Founder of the Apple Co, he quoted, “Stay Foolish, Stay Hungry.” He emphasized the importance of having good discussion, right thoughts and accepting the viewpoints of others. He believed, “During discussion, it is good to make a point rather than not to make a point.”

Justice Ahluwalia encouraged the participants to develop the art of conversation, whereby viewpoints are acceptable. He said, “While developing conversation, one must develop eloquence and expression of thoughts. One must also develop a sense of humour and presence of mind.” He believed that the ideas can change the world. He also talked about the rule of law which is acceptable to all.  

Hon’ble Chancellor Dr. Sandeep Bakshi graced the occasion. Dr. Bakshi was quite impressed with the topics introduced in MYUN. Dr Bakshi believed this event aims to engage youth leaders from all over the world and to provide a platform to share perspectives in opinions. He said, “It is a platform where youth mentality in leadership, negotiation and diplomacy will be developed in a Model United Nations.”

During the programme, Hon’ble Vice Chancellor Prof (Dr) H.N. Verma, said that the MYUN is a place where the students played the role of politicians and delegates of various nations and expressed their views on difficulties the world faces. It will be an experience which will benefit the students to sharpen their speaking and listening blades and also enhanced their knowledge about the procedure for resolution and amendment along with the development of leadership and management skills.”

Driven by an educational mission that intends to shed light on the importance of collaboration, the art of diplomacy and the value of key skills such as research, public speaking, debate and negotiation, the Seedling School of Law and Governance initiated its 2nd edition of Model Youth United Nations, which has brought together students from different schools and institutes to discuss the problems of national importance. The programme will be for 2 days 13th and 14th April, 2019

With focus on different issues, about 160 participants from different parts of the country brainstormed the solutions to bring about the positive changes in the communities.

The 2nd Edition of the ongoing event aims to inspire the delegates to transform their constructive dialogue in committees into real and decisive action through different themes.

The committees and agendas are as follows:-

  1. United Nations General Assembly – “Rights and Discrimination Against LGBT Community”
  2. United Nations Human Rights Council – “International Terrorism”
  3. Lok Sabha – “Caste Based Reservation”

“MYUN is giving students a platform to improve their leadership skills. This event focuses on helping students translate their global learning from the committees and interactions at the conference into impactful local actions,” Dr. T.N. Mathur, Director of Seedling School of Law and Governance. is an innovative platform to hone the public speaking and argumentative skills of the students by discussing matters that concern the youth at national as well as international level.

“MYUN India is striving to bring together student leaders, who hope to improve their societies through innovative and wide-ranging voices and develop the world socially, economically, and politically to create a better future for all of us,” said Dr. Mithilesh Vishwakarma, Head of the Department, Seedling School of Law and Governance, Jaipur National University. He further said, “The participating students come as delegates of a sovereign nation for the entire duration of the conference. MUN serves as a platform for students to get involved in International Affairs, hone their diplomatic skills and develop confidence in Public Speaking. This meet is aimed to provide the youth an opportunity to learn and develop the art of diplomacy, understand the international relations among nations and deliberate on the common problems faced every creature on this globe, be it social, economic, political or related to an environment suitable for peaceful co-existence of flora and fauna”.

While giving the vote of thanks, Mrs. Komal Audichya, Senior Coordinator and Faculty Convener of MYUN, Seedling School of Law and Governance, said, “This event is a spark which ignites one’s mind with enthusiasm and confidence. School of Law and Governance, Central University of South Bihar has won the 7th Mahamana Malaviya National Moot Court Competition, 2019 organized in BHU from 5th-7th April, 2019.

CUSB defeated Army Institute of Law, Mohali in finals. A total of 24 teams from Law Schools all over India participated in this competition. A few prominent teams participating in this national moot were from Delhi University, Amity Law School, Delhi, NUALS, Kochi, MNLU, Aurangabad, ULC, Bangalore and Lloyd Law College, Noida.

The CUSB Team comprised of Tanay Akash, Anand Shukla and Gargi Upadhyaya. Tanay Akash is currently a research fellow working with the Legal Desire. The team has thanked their faculty members, seniors and classmates for the immense support. They have also thanked Legal Desire for providing the research materials for the moot court preparation.

The CUSB Team won this moot second time consecutively in a row. Last year, CUSB won this moot by defeating KIIT Law School, Odisha in the finals. Last year’s team consisted of Vishal Kumar Singh, Amar Vivek and Abhishek Raj. Vishal Kumar Singh is currently the Assistant Director of Operations in Legal Desire Media and Publications.

Brave young law students from RGNUL,Patiala have ended their protest. As a Law student, I can understand that how they must have felt, while fighting lawfully on an issue against an institution, which itself taught them to stand for their rights. Countering an injustice in and against an institution which itself stands on the principles of law and justice, is really harsh and unfortunate.

Here is a detailed report of what actually happened in RGNUL for the last five days:

On 13th March, A wire was found in food in boys mess. The students intimated hostel authority and mess. This led to slamming of empty plates in cohesion by all boys in the hostel of all batches on their respective tables.

On 14th March, 6 students were called individually at 10:30 pm without announcement , faced with questions. One person treated with abuses and coerced to surrender phone with password. 

On 15th March, the Suspension order delivered on call for these 6 students of the same batch and enforced at 3:00 pm for ‘violence’ and destruction of college property.

At around 8 pm some boys started peaceful sitting in front of guest house. The silence lasted till 1 am and was turned into slogans followed by the students from the girls hostel joining the demonstration. Since the inception two letters were drafted and sent to the administration inside for communication and negotiation to no heed. Children were subjected to lathi police formations, gun displays etc. The peaceful protests primarily focused on the invalid suspension order, suspension of the Administrative officer for various allegations of harassment, the constitution of a student body and addressing general mismanagement and sexist environment at the university.

On 16th March, all students slept on the road. No food, water or blankets were provided. Provisions of departmental store also closed down. At 9:30 AM, Honb’le Judges of the Punjab and Haryana High court tried to mediate with students, on representation of Chancellor and requested the 6 students to come back, calling such an order to be ‘wrongly carried out ‘. At 12:00 pm a meeting was concluded between students, judges and the administration promising a meeting with the Chancellor the following day. However, at 4:00 PM another representative of the Honb’le chancellor, uninformed to students, was called by the university to its guest house. Students protested and negotiated , yet their demands were replied to with vague assurances and the earlier promises to have a democratic dialogue with the Chancellor were denied. Further a full fledged campus candle march was effected. The students then slept outside the vice chancellor’s residence.

On 17th March, the demands were put again, media attention was ascertained. However, media entry in the campus was barred by the administration. The students tried negotiating with the vice chancellor and the faculty. The vice chancellor declares all power to modify and make such rules rests solely with the Chancellor. Negotiations failed for the second time when the alumini association tried mediating as representatives, yet the demands were not met regardless of such reasonable efforts. The students slept at the main gate in the same way.

On 18th March, the Students chose to protest by not giving mid semester examinations, commencing the week. The authorities called in Rapid Action Force and other police officers, perhaps in wake of such protest. This was the 4th day today of protest. Students slept last night on the roads in mass protest and we are boycotting the mid semesters exams today.

On 19th March, around 8:00 PM, the administration promised to fulfill the demands and students called off the protest.

So, this all started with a small issue of some irregularity in the mess food, which generally happens in the Indian Universities most of the times. But, what shall be noted is the attitude of the institution. Students pay a fortune to read in NLUs and if they demand good (atleast eatable) food, there is nothing wrong in it. In my utter faith and an honest belief with the Bar Council of India, I strongly think that BCI should have taken suo-motto cognizance of the matter and would have intervened. We, no more want  KIIT or HNLU incidents in our colleges.

“Power Corrupts and absolute power corrupts absolutely”. This quote by “Sir Arnold” seems to be best fit for the authorities of the Rajiv Gandhi National University of Law, Punjab. National Law Universities, the islands of legal excellence in India , which foments injustice with a responsibility to turn the young legal minds into legal luminaries. In one of such NLUs, Rajiv Gandhi National University of Law, Punjab (RGNUL) a very sad incident took place on 13th march 2019.

As per RGNLU-ites on the evening of 13th March, a collective of Boys students across batches, numbering into hundreds held a protest in the mess over the bad quality of food which had been persisting for long. On the 15th, 6 students were identified, harassed and suspended from the campus on account of indiscipline and hooliganism  – all that with a mere 3 days to go before the mid-semester exams. Without conducting any hearing, violating the natural justice (“audi alteram partem”) order of suspension was passed wrongfully – by the Administrative Officer even when a penalty of suspension can only be passed by the Vice Chancellor.  Moreover, phones have been confiscated, through coercion have been unlocked, private messages breached and upon insisting that fundamental rights of privacy are being violated, the Faculty responded with abuses and stating that the students are in no position to teach them the Law. All of this in an institution committed to uphold natural justice.

It was further claimed that this behavior of the University Administration has precedence. This is not the first time RGNUL Administration has behaved in a dictatorial manner, but is one in a series of occurrences.

The appeal made by the students to the authorities were that the six students who are wrongfully suspended be, during the pendency of their inquiry, be reinstated hostel and campus privileges. To that extent, since 8:15 PM the 15th of March, hundreds of students have been holding a peaceful silent protest in front of the Guest House in solidarity with the suspended students.

This protest is still continue and the students are even sleeping on the campus roads for protest leaving a huge question mark over the authorities and the educational legal system of India that if such incidents are taking place in university which is producing young legal minds, how can justice can be expected in the incidents of other universities? Also, the victims of such injustice are not only the immediately affected students, but the legal fraternity and the nation at large.

IFIM Law School Bangalore, hosted an International Conference on Law and Regulation of Artificial Intelligence at the campus today. Former Chief Justice of India Hon’ble Dipak Misra and Justice Dominique Hascher, Judge at the Supreme Court of France, were the chief guests for the occasion.

In his inaugural speech, Justice Misra said, “The future of any new-age technology lies in the regulations that govern them. Artificial Intelligence promises a high growth potential in a number of sectors. However, it needs a strong legal framework around it to explore maximum benefits. AI today is growing multi-fold and we still do not know all the advantages or pitfalls associated with it which are yet to be completely discovered. This is why it is of utmost importance to have a two-layered protection model; one, technological regulators; and two, laws to control AI actions as well as for accountability of errors. India has the right talent and technological resources. With a powerful legal directive, the country can set many milestones with a strong command over Artificial Intelligence.”

India currently does not have specific regulations that govern Artificial Intelligence. However, the country will be following the lead of countries such as Canada, Singapore, France, China and the UK, to name a few, to formulate and eventually implement policies and regulations that control the use of AI.

Interim Finance Minister Piyush Goyal in his Budget 2019 announced earlier this month that the Government of India was considering a National Centre for Artificial Intelligence, and will also be unveiling a national AI portal soon.

Justice Dominique Hascher, Judge at the Supreme Court of France, addressed the global scene on the regulation of Artificial Intelligence (AI). “Each nation today aims to become a global leader in Artificial Intelligence. Hence, countries like the USA, the UK, China, and Germany are increasing investments to leverage this technology. However, private technology companies are acing the field. India’s unique challenges and aspirations, combined with the advancements in AI, and a desire to assume leadership in this nascent technology means India’s approach towards AI strategy has to be balanced for both local needs and the greater good. A strong regulatory system around this can ensure long-term benefits and growth,” said Justice Dominique in his keynote speech.

Dr Avinash Dadhich, Principal and Associate Dean at IFIM Law School, expressed the importance of the academia to guide the future of legal education in India. “The Industrial Revolution 4.0 promises a brighter future. The new age technologies such as Artificial Intelligence and Machine Learning need to be comprehended well for its easy adoption across industries. The legal fraternity here will play a key role here to develop an understanding of its use by judiciary. Legal practice is never limited to any single sector. Hence, young lawyers today need to be well-versed with what the Industrial Revolution 4.0 offers.”

Other speakers at the event included Prof. Joel Moneger, Dauphine University, Paris, Prof. P. Ishwara Bhatt, Vice-Chancellor of KSLU, Prof. Nandimath, Registrar, NLSIU, Bengaluru and Prof. Jacques Larrieu, University of Toulouse, France. IFIM Law School also published a survey report on views of the legal fraternity with regard to the integration of AI with law in India.

The National Conference was organized and hosted by JEMTEC, School of Law on April 21st, 2018 on Emerging Trends in International Law: Issues and Challenges, aimed at building a bridge to contribute to development of nations in the international regime in the auspicious presence of delegates and speakers coming from all over the country.

The conference was inaugurated in the presence of the Chief Guest Mr. Vikramjit Banerjee, Additional Solicitor General of India, and the Guest of Honor Mr Narinder Singh, Former Secretary General of the Indian Society of International Law, New Delhi, Dr. Amit Gupta, Chairman JIMS Group & Patron-in-Chief of the conference, Dr. R.K. Raghuwanshi, Programme Director and Prof (Dr.) K. K. Geetha (Convener) followed by lighting of lamp. A warm welcome speech was given by Dr. Amit Gupta (Chairman) and Dr. R.K. Raghuwanshi (Director).

The conference was well attended by eminent academicians, faculty members and students from reputed institutions of law such as Maharashtra National Law University, Nagpur; CNLU, Patna; JNU, Delhi; Jamia Milia Islamia; Faculty of Law, Delhi University; Aligarh Muslim University; Nirma University, Ahmedabad; VIT, Chennai; UPES, Dehradun; Himcapes School of Legal Studies, HP; Geeta Institute of Law, Panipat; Amity Law School, Delhi; Sharda University; Lloyd Law College, Greater Noida; Galgotias University, Greater Noida; and many more, from different parts of the country and representatives of different legal departments and legal professionals.

Six sessions on Challenges before Public International Law, International Law in Cyber Space, International Environmental Law, International Refugee Law, International Maritime Law were held and number of papers were presented. These sessions were chaired by the persons of repute in the area of International Law like Dr Stellina Jolly, Assistant Professor, South Asian University, New Delhi, Mr Rodney D. Ryder Senior Partner, Scriboard Research and Development Center, Advocates and Legal Consultants, Mr Vinai Kumar Singh, Deputy Director, ISIL, New Delhi, Ms Meena Panicker, Assistant professor, Delhi University, Dr. Anwar Sadat, Assistant Professor, ISIL, New Delhi and Faculty members of JEMTEC School of Law namely Mr Ashutosh Kumar, Mr Siddharth Singh, Mr Ashish Saraswat and Mr Arpit Sharma.

The valedictory ceremony was attended by Dr. Manoj Kumar Sinha, Director, Indian Law Institute, New Delhi and Mr Luther Rangreji, Director, Treaty Division, Ministry of External Affairs, as Chief Guest and Guest of Honor, respectively.

Out of approximately 50 participants’ the best paper was awarded to Dr. Murshed Mussarraf, Department of Pol. Science, BFIT, Group of Institute, Dehradun.

It is a known fact that none of the nations can survive in seclusion and there is an obligation to establish a well knitted inter-state relationship. There is a constant strife between new international economic order and traditional interpretation of international principles.”

The main aim of the National Conference is to deliberate on themes: Challenges before Public International Law, International Law in Cyber Space, International Investment and Trade Law, International Environmental Law Issues and Challenges, International Refugee Law, International Maritime Law.
